As he was leaving for Germany to continue his world tour, JYJ member Kim Junsu heard the news that the legal issues between JYJ’s former entertainment company, SM, were finished. Along with fans, he, too, was startled to hear the lawsuit was finished. He said, “The legal battle lasted for 3 years and 4 months. To be honest, it should have ended earlier… But at the same time I also feel that the results came out suddenly. Having had a hard time for 3 years and 4 months, I felt like that time was not spent in vain… I heard the news when I was leaving for Germany, so I actually don’t know all the details of the settlement.”
However, he stated there was much positivity from the settlement, as JYJ was finally granted their independence from SME. Not only that, but he was happy to know the lawsuit helped future hoobaes as well as the ones currently in SM to have a better suited contract with the company.
Despite all of this, Junsu commented on the further decreased possibility for TVXQ to return as a five-member group. “A lot of time passed, but one unfortunate fact is that we can no longer have activities under the TVXQ name. We wanted to fight against the company’s unfairness, it wasn’t that we wanted to leave TVXQ. It just had to happen. It’s regretful and saddening. I feel sorry to the fans, but the title of TVXQ will remain forever. But realistically, it’s going to be difficult to promote as TVXQ again.”
At his press conference in Germany, Junsu continued with “I, too, find this situation to be unfortunate because I entered the entertainment industry and started out as a singer through TVXQ,” and “Though the situation is unfortunate and regrettable, the title of ‘TVXQ’ will always remain in my heart and I believe that other people, and not only myself, will remember and never forget the five years that I performed as a member of TVXQ.”
He continued to add, “Nothing will ever be as memorable and fill me with joy than if I could stand on stage again as ‘TVXQ’ one day.”
Kim Junsu didn’t hide his affection for TVXQ as he said, “We were fighting a battle against our company (SM Entertainment) and their unlawful practices; it wasn’t that we wanted to throw away our title of ‘TVXQ’ or leave ‘TVXQ’.

After being at battle for over three years, idol group JYJ (Kim Jaejoong, Park Yoochun, and Kim Junsu) and SM Entertainment has finally come to a conclusion to their never-ending lawsuit. Back in July of 2009, JYJ filed a lawsuit against their former entertainment company SM due to the infamous 13-year contracts SM artists were under as well as the unfair profit distribution among the members. There is no clear statement as to what exactly happened from 2008-2009 between the members and the company, however, numerous conspiracy theories do exist on the matter.
Because of the three lawsuits JYJ filed against the company, SM made it extremely difficult, if not impossible for the group to appear on television whether it was to promote their music or their personalities. As the back and forth libel and slander continued between the two groups, on Wednesday morning, November 28, 2012 a mutual agreement was made, making JYJ currently free from their contract under SM Entertainment. In addition, JYJ can now promote freely and both groups will no longer interfere with each other’s activities. As this is all very good news, the unsettling part arrived shortly after SM gave their closure on the lawsuit. Continue reading
